Terms of Service

These Terms (“Terms”) govern your use of Bot Bloke’s services — including AI chatbots, voice receptionist, SEO content, and analytics (“Services”) — delivered via Bot Bloke’s website, client websites, or social messaging platforms. By using our Services, you (“Customer” or “you”) agree to these Terms and our Privacy Policy.

1. Account & Access

You must create an account to access the Services. You agree to provide accurate details and keep your login credentials secure. Bot Bloke may suspend or restrict access if you violate these Terms or have unpaid fees.

2. Our Services

We deliver the following services tailored for Australian businesses:
• AI Chatbots – Website widgets designed to engage visitors, capture leads, and manage bookings.
• AI Voice Receptionist – Automated call-answering service to book jobs and handle enquiries when you’re unavailable.
• Relevant AI Integrations – Connected tools provided as needed to support your business.
• Daily AI-Optimised SEO Content – AI-driven blog posts to enhance your online presence.
• Monthly Analytics & Dedicated Management – Performance reporting and expert support to optimise outcomes.

We aim for continuous availability but may need to pause Services for maintenance or updates.

3. Fees & Payment

• Fees are based on the selected plan: Starter, Advantage, or Premium.
• A one-time setup fee is required to integrate the chosen plan (discussed during the Demo meeting).
• Service charges are billed according to the chosen payment cycle (monthly or annually).
• Annual payments are offered at a discounted rate, and all payments are due in advance.
• Late or missed payments may result in suspension of Services until the balance is cleared.

4. Data & Privacy

• Customer data collected through our Services (including leads, chat transcripts, call recordings, and analytics data) remains the property of the client.
• Bot Bloke acts solely as a data processor for this information and will use it only to deliver the agreed Services.
• Our Services operate using trusted third-party platforms (including GoHighLevel and its sub-processors). By using our Services, you consent to data being processed through these providers in accordance with their privacy policies.

5. Account Cancellation and Data Retention

We require at least 3 months of continued payments. This provides us with adequate time to properly assess, train and change bots if need be. Following the 3-month period, you will be able to terminate at any time by providing a 30-day written notice period to advise us of your intent to terminate. If you are on the annual plan, we will provide you with a pro-rata refund for the remaining period of your annual package.

If a client chooses to cancel services with Bot Bloke, your account will be deactivated but not deleted. All associated data will remain securely stored on our systems in a deactivated state. If a client wishes to have all account data permanently removed, they must submit a written request to Bot Bloke. Upon receiving this request, we will permanently delete all associated data from our systems within a reasonable timeframe. Please note that once deleted, data cannot be recovered.

6. Usage & Conduct

You agree that your use of the Services will:
• Comply with all applicable Australian laws and regulations.
• Not include malicious content (e.g. malware) or unauthorised automation.
• Respect the integrity and performance of Bot Bloke’s systems.

7. Intellectual Property

All technology, software, and creative materials used or provided by Bot Bloke remain the property of Bot Bloke. You may not duplicate, reverse-engineer, or repurpose them without prior written consent.

8. Disclaimer & Limitation of Liability

Services are provided “as is.” We do not guarantee uninterrupted performance, accuracy, or specific business results. Under no circumstances will Bot Bloke be liable for indirect or consequential damages. If Services are interrupted, you must notify us so we can address the issue promptly.

9. Termination

Either you or Bot Bloke may end Services with reasonable notice. On termination, you will lose access, and any outstanding fees become due immediately. We may retain data as required under Australian law.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and disputes will be resolved in the courts of New South Wales.

11. Updates to Terms

We may occasionally update these Terms. Major changes will be communicated in advance; minor updates take effect immediately. Continued use of our Services implies acceptance of the updated Terms.
